My T&C’s

Overview & summary

I aim to avoid complicated legal terms or long passages of unreadable text – this is not about tricking you into agreeing something that you might later regret.

Before we start working together, I will ask you to sign a short terms & conditions document that is confidential and exists to protect the interests of all involved parties, to outline our responsibilities to one another, and to avoid any confusion or disappointment during and/or after our time working together.

If anything is unclear, please do not hesitate to ask questions.

You can request amendments and additions prior to signing my documents.

Payment terms

All time and costs will be agreed before our work together commences.

Following that, invoices are raised monthly in arrears, and I ask that payment is made within 14 days.

All payment is in UK sterling and is only accepted via BACS payment.

All work remains the property of Catherine Coale until final invoice is settled.

If the invoice goes overdue, a reminder will be sent, and I reserve the right to charge statutory interest from that point.

Statutory interest will be accrued for each day overdue, in line with UK Government late payment legislation and fair payment code.

If the payment has not been received within 30 days of the original due date, I reserve the right to cancel any future commitments we had planned together, without penalty.

Fees

My services can be engaged on hourly or daily rates plus expenses and travel time. These will be agreed in advance, so we all know what to expect.

Mileage is charged at 45 pence per mile.

I am not currently registered for VAT, and therefore no VAT will be charged on your invoices.

Cancellation, refunds and notice periods.

I reserve the right to cancel my services at any time and a pro-rata refund will be allocated depending on circumstances. If a client breaks the terms of service a refund will not be issued.

Clients may cancel their account with me at any time.

For hourly rate work without a retainer, one week’s notice is requested.

For work with a retainer, the notice period will be agreed before commencement.

Clients who wish to cancel will not be entitled to a refund for any deposits or services paid for.

Copyrights

When your final payment has cleared, copyright will be automatically assigned as follows:

You’ll own any documentation or digital output that I create specifically for you during our contract, within the scope of what we have agreed.

You will own all source files and finished files, and you should keep them somewhere safe.

You own all elements of text, images and data you may provide me with in the course of my work, unless someone else owns them.

I would like to showcase our work and share what we’ve learned with others, so may reference on my website and/or social media and link to any project we may have worked on during this engagement. I will be sensitive and considerate about what is shared, and it will be in line with any confidentiality arrangements that we have agreed.

Disclaimer

Catherine Coale will not be responsible for any damages your business may suffer. I make no warranties of any kind, expressed or implied for services I provide.

Clients must indemnify Catherine Coale against all damages, costs, claims and expenses arising from any loss or damage to any equipment (including that belonging to third parties) caused by me or my agents or employees.

By signing up for any of my services you agree to be bound by all terms and conditions.
